Terms of Service - Yoga Daily

These Terms of Service (“Terms”) are an agreement between you and Yoga Daily LLC, a Wyoming limited liability company (“Yoga Daily”, “we”, “us”). They apply to yogadaily.com and to our live classes, replays and membership at classes.yogadaily.com (the “Services”). By using the Services or buying a membership, you agree to these Terms.

Health disclaimer and assumption of risk

Yoga and movement involve physical activity and carry a risk of injury. Our classes and content are for general education and fitness only and are not medical advice. Talk to your doctor before starting any exercise program, especially if you are pregnant, have an injury or a medical condition, or have any doubts about your health. Listen to your body, modify or stop any pose that causes pain, and practise in a safe space. You take part at your own risk and are responsible for your own safety. To the fullest extent permitted by law, Yoga Daily is not liable for injuries or damages arising from your practice.

Your account

You must be at least 18 years old to buy a membership. Keep your login details private and do not share your account. You are responsible for activity on your account and for giving us accurate information.

Membership, billing and cancellation

Price and billing: the membership is billed monthly in US dollars at the price shown at checkout, and renews automatically until you cancel. The founding member price shown at checkout stays the same for as long as your membership remains active without a lapse.
Cancel anytime: you can cancel at any time from your account or by emailing hello@yogadaily.com. After you cancel, you keep access until the end of the period you have already paid for, and you will not be charged again.
Refunds: payments are not refundable once a billing period has started, except where required by law or where we decide otherwise in a particular case. If you were charged by mistake, contact us right away.
Price changes: we may change prices for new members at any time. If we change the price of an existing membership, we will tell you in advance.
Taxes and payment: prices may be subject to applicable taxes. Payments are handled by third-party payment providers.

Live classes and recordings

Live classes are held on Zoom and are recorded. Replays are available to members on the membership platform. Class times, teachers and the schedule may change, and we may cancel or reschedule a class. By joining a class with your camera or microphone on, or by using the chat, you agree that your image, voice, name and messages may be recorded and made available to members as part of the replay.

Our content and your use of it

All classes, videos, recordings, text, images and other content are owned by Yoga Daily or its licensors and are protected by copyright and other laws. Your membership gives you a personal, non-exclusive, non-transferable licence to watch the content for your own non-commercial use. You may not copy, download, re-record, share, resell or publish it, or share your login, without our written permission.

Acceptable use

Do not misuse the Services, disrupt classes, harass other members or the teacher, post unlawful or offensive content, or try to access parts of the Services you are not authorised to use. We may suspend or end access for anyone who breaks these Terms.

Disclaimers

The Services are provided “as is” and “as available”. We do not guarantee any particular result from using them, or that the Services will always be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, Yoga Daily and its owners, teachers and service providers are not liable for any indirect, incidental, special or consequential damages, or for loss of profits or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Where the law of your country gives you mandatory consumer rights, those rights are not affected.

Changes

We may update these Terms from time to time. If we make a material change, we will post the updated Terms here. Continuing to use the Services after a change means you accept the new Terms.
